These Terms and Conditions constitute a legally binding agreement between you and Liberty Platform PTY LTD (ACN 694 912 126, ABN 83 694 912 126), operating the digital financial platform accessible at libertystone.com and libertystone.com.au.

By accessing, registering for, or using any part of the Platform, you unconditionally accept and agree to be bound by these Terms.

If you do not agree to these Terms, you must immediately cease using the Platform. Liberty Platform PTY LTD may modify these Terms at any time, and continued use following any modification constitutes acceptance of the revised Terms.

Liberty Platform PTY LTD is registered in Australia under ACN 694 912 126. The company operates as a Corporate Authorised Representative of YP Securities Pty Ltd (AFSL 531729) under the Corporations Act 2001 (Cth).

This arrangement authorises the Company to provide certain financial services as described in these Terms and in the associated Financial Services Guide.

The Platform provides access to cash account management and multi-currency services, securities brokerage and investment services, managed investment scheme access and administration, and SMSF administration and reporting tools.

Certain features of the Platform are provided by or in partnership with third-party regulated service providers. The specific regulatory framework applicable to each service is disclosed within the relevant product terms, Financial Services Guide, and associated Product Disclosure Statements.

To be eligible to use the Platform, you must be at least 18 years of age, be an Australian resident or citizen or otherwise permitted by applicable law to access the Platform, have legal capacity to enter binding contracts, and not be prohibited by applicable law or regulation from receiving the services offered by the Platform.

If you access the Platform on behalf of a corporation, trust, SMSF, or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms, and references to you include that entity.

You acknowledge that the Platform is required by law to verify your identity and may collect, verify, and retain identity documentation in accordance with the AML/CTF Act and the Platform's AML/KYC Policy.

To access most features of the Platform, you must create an account and provide accurate, current, and complete registration information, updating it as necessary.

You are solely responsible for maintaining the confidentiality of your login credentials, for all activity that occurs under your account, and for promptly notifying the Platform of any unauthorised use or security breach.

The Platform will never request your password via email, phone, or any unsolicited communication.

Liberty Platform PTY LTD reserves the right to suspend, restrict, or terminate your account at any time, with or without notice, for breach of these Terms, false or misleading information, suspected fraud, failure to maintain verification, legal or regulatory direction, or prolonged inactivity.

The Platform provides access to financial products and services either directly or via regulated third-party partners. The specific terms, fees, risks, and features of each product are described in the relevant product documentation, including Product Disclosure Statements and Target Market Determinations available on the Platform.

Any information provided by the Platform or its representatives constitutes general financial advice only and does not take into account your personal financial situation, objectives, or needs.

Before acting on any information, you should consider its appropriateness having regard to your own circumstances and, where appropriate, seek independent personal financial advice from a licensed adviser.

All investments involve risk, including the potential loss of capital. Past performance is not indicative of future performance.

AUD cash account services are provided in partnership with regulated payment infrastructure providers. Client funds held in AUD cash accounts are maintained with a licensed and regulated financial institution, but the Platform is not itself an Authorised Deposit-taking Institution and does not guarantee deposits beyond what is provided by the underlying regulated partner.

The Platform generates revenue through various fee structures disclosed transparently within the relevant product documentation and fee schedule accessible on the Platform.

These may include brokerage fees on securities transactions, foreign exchange spread on multi-currency conversions, platform and administration fees, and placement and deal access fees for managed investment products.

All fees are subject to change. Updated fee schedules will be published on the Platform with reasonable notice prior to implementation, and continued use following a fee change constitutes acceptance of the revised fees.

You agree not to use the Platform for any purpose that is unlawful, harmful, or prohibited by these Terms.

  • Money laundering, terrorism financing, or activity prohibited under AML/CTF laws.
  • Market manipulation, insider trading, or securities fraud.
  • Using the Platform in connection with any criminal enterprise.
  • Circumventing any technical security measure or access control.
  • Introducing malware, viruses, or harmful code into the Platform's systems.
  • Misrepresenting your identity or impersonating any person or entity.
  • Engaging in activity that would expose the Platform or its partners to regulatory, legal, or reputational risk.
  • Using the Platform from jurisdictions where such use is prohibited by law.

All content, trademarks, trade names, logos, software, processes, and materials published on or accessible via the Platform are the intellectual property of Liberty Platform PTY LTD or its licensors.

You may not copy, reproduce, distribute, modify, or create derivative works from any Platform content without prior written consent from Liberty Platform PTY LTD.

§ 09

Privacy

The collection, use, storage, and disclosure of personal information is governed by the Platform's Privacy Policy, which forms part of these Terms and is available at libertystone.com.au/privacy.

By using the Platform, you consent to the collection and use of your personal information as described in the Privacy Policy.

To the maximum extent permitted by law, Liberty Platform PTY LTD and its officers, directors, employees, agents, and authorised representatives are not liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of, or inability to use, the Platform.

This includes loss of profits, revenue, or investment returns, loss of data or business opportunity, damage caused by third-party service disruption, and market movements or investment losses.

Nothing in these Terms excludes liability that cannot be excluded under applicable Australian consumer protection legislation.

You agree to indemnify and hold harmless Liberty Platform PTY LTD, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses arising out of or in connection with your breach of these Terms, violation of law or regulation, or use of the Platform.

The Platform integrates with and depends on third-party services including payment processors, brokerage providers, and identity verification services. The Platform is not responsible for the acts, omissions, or service quality of third-party providers, and your use of those services may be subject to their additional terms.

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to conflict of law principles.

In the event of a dispute, you agree to first contact the Platform's internal dispute resolution process as described in the Complaints Policy available at libertystone.com.au/complaints.

If the matter remains unresolved, it may be referred to the Australian Financial Complaints Authority (AFCA).
